Water Delivery Contract

  • I, the undersigned, agree to the following:
  • 2) I understand that since the tank and fill and vent piping are part of my property I am responsible to make sure it functions properly. I agree to maintain the tank and piping in good working order. In the winter I will keep all lines thawed and clear of ice or frost. If the tank or its associated piping system overfills, bursts, or fails, I am solely responsible for any and all damages that are a result of such failures.

    3) I also understand that since I control the use of the space in which the tank located that I am responsible for any water damage to the building structure and components and personal belongings that I have located in the vicinity of the tank.

    4) Water Wagon delivers potable water and it’s vital that Water Wagon personnel make every effort to maintain the quality of the delivered water. As the property owner or tenant it is my responsibility to keep a clear and clean pathway to my water tank, fill pipe, and to any other access points that Water Wagon personnel are required to visit to deliver my water. If pathways are found to be unsafe and/or unclean Water Wagon will halt deliveries until such time the unsafe and/or unclean conditions are resolved.

    5) During the winter, it is my responsibility to maintain my driveway(s). I will provide snow removal for a minimum of 10 feet wide road way, and clearly mark deep inclines or ditches located adjacent to the driveway. I will also clearly mark or flag any areas (gardens or lawns) where I don’t want the water truck driver to traverse with the water truck or drag a hose. In the spring, snow hard pack should be no thicker than 4 inches. In the summer, driveways that are topped with pit run or silt may cause soft road conditions which will cause Water Wagon to refuse to make deliveries. Low hanging branches of trees that are located adjacent to roadways can cause damage to water trucks making water deliveries. I agree to remove any low hanging limbs or bent over trees that are identified by Water Wagon for removal. If I request water delivery when the condition of my driveway is marginal, then I am responsible for any damage caused by a water wagon truck spinning tires, sinking into the driveway, or sliding off of driveway. Furthermore, I will reimburse Water Wagon for any costs related to having a truck removed from my driveway.
